Die Selbstjustiz widersetzt sich dem Gewaltmonopol des Staates und ist in diesem Rahmen strafbar. Der Staat behält sich das Recht der Bestrafung als Dritter selbst vor. Daher wird das Pendant der Selbstjustiz auch als „Fremdjustiz“ bezeichnet.
