A treaty is an agreement under international law entered into by actors in international law, namely states and international organizations. A Treaty may also be known as: (international) agreement, protocol, covenant, convention, exchange of letters, exchange of notes, memorandum of understanding, etc. Regardless of the terminology, all of these international agreements under international law are equally treaties and the rules are the same.

Ein Vertrag im Sinne des Völkerrechts ist eine Abmachung zwischen zwei oder mehreren Staaten in traditioneller Rechtsform. Er setzt, analog zum Vertrag im Privatrecht, die Handlungsfähigkeit der Partner, im völkerrechtlichen Sinne also zumindest eine beschränkte Souveränität der beteiligten Staaten, voraus.

Een verdrag is een schriftelijke overeenkomst tussen twee of meer partijen van bindende aard, in het Nederlands (in tegenstelling tot het Duits) alleen gebruikt als de verdragsluitende partijen staten of volkenrechtelijke instellingen zijn.
