A pardon is the forgiveness of a crime and the penalty associated with it. It is granted by a sovereign power, such as a monarch or chief of state or a competent church authority. Clemency is an associated term, meaning the lessening of the penalty of the crime without forgiving the crime itself. The act of clemency is a reprieve. Today, pardons and reprieves are granted in many countries when individuals have demonstrated that they have fulfilled their debt to society, or are otherwise deserving (in the opinion of the pardoning official) of a pardon or reprieve. Pardons are sometimes offered to persons who, it is claimed, have been wrongfully convicted. However, accepting such a pardon implicitly constitutes an admission of guilt, so in some cases the offer is refused.

Das Recht, Gnadenerweise zu erteilen (Begnadigung, Begnadigungsrecht, Gnadenrecht), umfasst die Befugnis, rechtskräftig verhängte Strafen (in Ausnahmefällen auch Maßregeln der Besserung und Sicherung) zu erlassen, umzuwandeln, zu ermäßigen oder auszusetzen.Die Begnadigung ist meistens Befugnis von Staatsoberhäuptern, die im Einzelfall Tätern die ihnen strafrechtlich zuerkannte Strafe erlassen. In dieser Praxis hat sich ein Rest des mittelalterlichen Gerechtigkeitsverständnisses erhalten, dass Autoritäten geltende Regeln willkürlich außer Kraft setzen können („Gnade vor Recht“). Die entsprechende generelle Maßnahme ist als Amnestie oder Abolition bekannt.

Ułaskawienie – indywidualny akt ingerencji odpowiedniego organu władzy wykonawczej lub w kompetencje władzy sądowniczej polegający najczęściej na całkowitym darowaniu kary lub też częściowym złagodzeniu postanowień  wyroku sądowego.Ułaskawienie jest tradycyjną prerogatywą głowy państwa (w przeszłości monarchy). W Polsce obecnie prawem łaski dysponuje na podstawie art. 139 Konstytucji Prezydent RP, nie stosuje się go jednak do osób skazanych przez Trybunał Stanu. W okresie Polskiej Rzeczypospolitej Ludowej prawem tym dysponowała Rada Państwa.

L'indulto è una causa di estinzione della pena prevista nell'ordinamento italiano dall'art. 174 del Codice penale. Si tratta di un provvedimento generale di clemenza, ispirato, almeno originariamente, a ragioni di opportunità politica e pacificazione sociale, ma a volte degenerato nella prassi in strumento di periodico sfoltimento delle carceri.
