Ostracism was a procedure under the Athenian democracy in which any citizen could be expelled from the city-state of Athens for ten years. While some instances clearly expressed popular anger at the victim, ostracism was often used preemptively. It was used as a way of defusing major confrontations between rival politicians (by removing one of them from the scene), neutralizing someone thought to be a threat to the state, or exiling a potential tyrant. Crucially, ostracism had no relation to the processes of justice. There was no charge or defense, and the exile was not in fact a penalty; it was simply a command from the Athenian people that one of their number be gone for ten years.

Der Begriff ist abgeleitet von Ostrakon , Tonscherbe, da Bruchstücke von Tongefäßen als „Stimmzettel“ verwendet wurden. Die Teilnehmer ritzten in die Scherben Namen von unliebsamen Personen ein; nach der Wahl wurde die meistgenannte Person für zehn Jahre verbannt. Der Verbannte durfte seinen Besitz behalten und war auch sonst nicht vollkommen entrechtet.

C'est un mécanisme d'auto-défense populaire, un simple vote de défiance politique : ce n'est pas une peine juridictionnelle, cette sanction n'est pas une condamnation pénale (pas de peine pécuniaire, conservation des droits civiques, etc.). Cette importante institution est marquée d'un grand esprit d'humanité tant dans la procédure suivie que dans la peine prononcée.

Ostracyzm (gr. ostrakon - skorupka gliniana) - tzw. sąd skorupkowy rodzaj tajnego głosowania wprowadzonego najprawdopodobniej przez Klejstenesa w 509 roku p.n.e. w Atenach. Przez dwadzieścia lat po reformach Klejstenesa nie skorzystano ani razu z tej procedury. Pierwszym poddanym tej procedurze był Hipparchos Pizystratyda (488/487 p.n.e.). Ostatni był Hyperbolos. , skazany w wyniku porozumienia pomiędzy Alkibiadesem i Nikiaszem, po klęsce wojsk dowodzonych przez Alkibiadesa w bitwie pod Mantineją w roku 418 p.n.e..
