A legal guardian is a person who has the legal authority (and the corresponding duty) to care for the personal and property interests of another person, called a ward. Usually, a person has the status of guardian because the ward is incapable of caring for his or her own interests due to infancy, incapacity, or disability. Most countries and states have laws that provide that the parents of a minor child are the legal guardians of that child, and that the parents can designate who shall become the child's legal guardian in the event of their death.

En droit français, la curatelle est une mesure prononcée par le juge des tutelles permettant la protection par un curateur d'un majeur incapable. Ce majeur peut accomplir certains actes de la vie civile seul, mais pour les actes de disposition (achat d’une maison, etc.), le majeur protégé doit les accomplir avec les conseils et le contrôle de son curateur.

Das Rechtsinstitut der rechtlichen Betreuung wurde in Deutschland durch das am 1. Januar 1992 in Kraft getretene Betreuungsgesetz geschaffen. Unter Betreuung wird die rechtliche Vertretung verstanden und nicht eine Sozial- oder Gesundheitsbetreuung. Die rechtliche Betreuung ist an die Stelle der früheren Vormundschaft über Volljährige und der Gebrechlichkeitspflegschaft getreten und geht über sie deutlich hinaus. Sie ist im Wesentlichen in den §§ 1896ff. des Bürgerlichen Gesetzbuchs (BGB) geregelt.
