In the constitutions of several countries, impeachment is the first of two stages in a specific process for a legislative body to remove a government official without that official's agreement. The second stage is called conviction.Impeachment is so rare that the term is often misunderstood. A typical misconception is to confuse it with involuntary removal from office; in fact, it is only the legal statement of charges, paralleling an indictment in criminal law. An official who is impeached faces a second legislative vote (whether by the same body or another), which determines conviction, or failure to convict, on the charges embodied by the impeachment. Most constitutions require a supermajority to convict.

L'impeachment (mise en accusation, en anglais, parfois traduit abusivement en français par le faux-ami empêchement ou encore procédure de mise en accusation dans le langage juridique) est le nom de la procédure permettant au pouvoir législatif de destituer un haut fonctionnaire d'un gouvernement. Cette procédure de destitution a pour but de permettre d'engager des poursuites judiciaires pénales à l'encontre des hauts fonctionnaires destitués. Littéralement, le mot signifie mise en accusation et on distingue cette mise en accusation du procès proprement dit, l'impeachment trial. Dans son usage courant, le terme désigne la procédure dans son ensemble ou la destitution à son issue.

Eine Anklage wegen Amtsvergehen (englisch impeachment) ist ein in der Verfassung der Vereinigten Staaten (Artikel II, Abschnitt 4) vorgesehenes Verfahren zur Amtsenthebung des  Präsidenten sowie anderer Amtsträger, zum Beispiel der Richter des Supreme Court, wenn diese „des Landesverrats, der Bestechung oder anderer schwerer Verbrechen und Vergehen für schuldig befunden worden sind“. Es ist sowohl auf Bundes-, sowie auf Staatenebene möglich, jedoch gelten hierfür andere Standards. Problematisch hierbei ist, dass diese „anderen schweren Verbrechen und Vergehen“ (other high crimes and misdemeanors) nicht eindeutig definiert sind und somit der Opposition als willkommene Hilfsmittel für politische Attacken gegen den Präsidenten dienen können.

Impeachment to termin pochodzący z anglojęzycznej tradycji parlamentarnej. Oznacza on procedurę formalnego oskarżenia o przestępstwa osób chronionych immunitetem i zajmujących wysokie stanowiska państwowe. Procedura impeachmentu wszczynana jest przez parlament lub inne ciała legislacyjne państwa. Impeachment nie musi być równoważny z automatycznym odsunięciem ze stanowiska oskarżanej osoby, ani z odebraniem jej immunitetu.

Col termine di origine inglese impeachment si intende la messa in stato d'accusa di titolari di cariche pubbliche, qualora abbiano commesso determinati illeciti nell'esercizio delle loro funzioni. Questo particolare vocabolo della lingua inglese si allaccia ai termini francesi empecher o empechement. L'impeachment è un antico istituto del diritto anglosassone; sviluppatosi dapprima in Inghilterra in un arco di tempo che va dal 1376, anno in cui il Parlamento mise in stato d'accusa alcuni ministri di Edoardo III e la sua amante Alice Perrers per corruzione e incapacità, al XVII secolo, è stato poi previsto e disciplinato dai padri costituenti degli Stati Uniti d'America nella Costituzione cosiddetta di Filadelfia del 1787, (all'art. 1, sez. 3) attualmente vigente.
