Guarantee
An enforceable legal instrument with which a customs administration can recover duties and taxes which become payable in the event of irregularities during a transit movement. Articles 359(2) & 367(1) of Commission Regulation 2454/93 and Articles 27(2) & 32(1) of Appendix 1 of the Common Transit Convention provide for three types of guarantee: Comprehensive Valid for a number of transit operations. The level of guarantee is negotiated between a principal and a customs administration, based on the volume of transit operations over a period of time. Individual Valid for a single transit operation, according to the amount of duties and taxes potentially payable. The individual guarantee can be deposited either in the form of a bank guarantee or as a cash deposit. Flat- rate Valid for a single transit operation and set at a fixed level of EURO 7000. Where a transit operation involves increased risks, the level may be set in terms of multiples of EURO 7000.
Excise business involves three categories of guarantees;
Dutch: Borg;Borgtocht
Bedrag dat geblokkeerd wordt bij een kredietinstelling als onderpand voor bepaalde faciliteiten; zoals uitstel van betaling.
De borg is de persoon die verantoordellijk is voor de gestelde borgtocht en bijgevolg ook de borgakte mee ondertekend heeft.
