Fraud
In criminal law, a fraud is an intentional deception made for personal gain or to damage another individual; the related adjective is . The specific legal definition varies by legal jurisdiction. Fraud is a crime, and also a civil law violation. Defrauding people or entities of money or valuables is a common purpose of fraud, but there have also been fraudulent "discoveries", e.g., in science, to gain prestige rather than immediate monetary gain.

Oszustwo
Oszustwo - przestępstwo polegające na doprowadzeniu innej osoby do niekorzystnego rozporządzenia mieniem własnym lub cudzym za pomocą wprowadzenia jej w błąd albo wyzyskania jej błędu lub niezdolności do należytego pojmowania przedsiębranego działania, w celu osiągnięcia korzyści majątkowej.
Pojęcie rozporządzenia mieniem ma na gruncie prawa karnego autonomiczny charakter i nie może być utożsamiane z rozporządzeniem rzeczą w rozumieniu prawa cywilnego. Rozporządzeniem będzie każda dyspozycja pokrzywdzonego prowadząca do zmiany stanu majątkowego własnego lub innej osoby.
Znamię niekorzystności nie jest równoznaczne z wystąpieniem szkody po stronie pokrzywdzonego. O niekorzystności rozporządzenia można mówić już wtedy, gdy zmiana stanu majątkowego nosi zdecydowanie ujemny charakter, choć nie przejawia się w postaci konkretnego uszczerbku. Dyspozycją taką może być prolongata długu lub udzielenie kredytu bez należytego zabezpieczenia. Ocena niekorzystności następuje na chwilę doprowadzenia do rozporządzenia, co oznacza, że późniejsze działania sprawcy np. spłacenie udzielonego kredytu, nie mają wpływu na byt przestępstwa, choć mogą rzutować na wymiar kary.
