Bail
Traditionally, bail is some form of property deposited or pledged to a court to persuade it to release a suspect from jail, on the understanding that the suspect will return for trial or forfeit the bail (and possibly be brought up on charges of the crime of failure to appear). In some cases bail money may be returned at the end of the trial, if all court appearances are made, regardless of whether the person is found guilty or not guilty of the crime accused. If a bondsman is used and a surety bond has been obtained, the fee for that bond is the fee for the insurance policy purchased and is not refundable.

Eine Kaution ist eine Sicherheitsleistung. Das Wort Kaution kommt aus dem Lateinischen , was „Sicherheit“, „Vorsicht“ bedeutet. Mit dem Begriff können ganz unterschiedliche Rechtsinstitute gemeint sein, beispielsweise die Bestellung eines Pfandrechts, das Stellen eines Bürgen usw.

Contrat de bail
Un contrat de bail ou un contrat de location est le contrat de louage par lequel l'une des parties (appelée bailleur) s'engage, moyennant un prix (le loyer) que l'autre partie (appelée preneur) s'oblige à payer, à procurer à celle-ci, pendant un certain temps, la jouissance d'une chose mobilière ou immobilière. Le contrat de location (c'est-à-dire la signature d'un bail) n'est donc pas restreint au seul domaine immobilier. Le bail peut porter sur des « biens meubles ou immeubles » comme l'indique, en droit français, l'article du Code civil français.
