Waqf

A waqf (, plural , awqāf; ) is an inalienable religious endowment in Islam, typically devoting a building or plot of land for Muslim religious or charitable purposes. It is conceptually similar to the common law trust.Awqaf were among the most important owners of property in the Islamic world until recent times, and remain significant. Their incomes support the upkeep of many mosques; in past times, charitable services such as hospitals and orphanages were often maintained by awqaf.The practice of declaring property as waqf gained considerable currency due to the practice in many Muslim states of expropriating the properties of important persons, especially officials, when they died or were disgraced. By declaring his estate as waqf and his descendants as trustees, a rich man could provide an income for his surviving family.

Dans le monde musulman, le waqf (pluriel : auqâf) est une donation faite à perpétuité par un particulier à une œuvre d'utilité publique, pieuse ou charitable. Le bien donné en usufruit est dès lors placé sous séquestre et devient inaliénable.

Waqf ( fromme Stiftung, plural Awqaf , türkisch Vakif, bosnisch u. bulg. Vakuf) ist eine islamische Institution, die vor allem vom 11. bis 19. Jahrhundert unter den Seldschuken und im Osmanischen Reich eine bedeutende Rolle spielte.Die Awqaf, auch Güter der toten Hand genannt, weil sie der Warenzirkulation entzogen sind, waren von Privatleuten finanzierte wohltätige Einrichtungen. Das konnten Moscheen, Schulen (Madrasa), Sufi-Konvente (Tekken), Krankenhäuser oder Einrichtungen zur Armenspeisung sein, aber auch Mühlen, Wasserräder, Bewässerungskanäle und öffentliche Brunnen. Davon zu unterscheiden sind Stiftungen des Sultans, bei denen bestimmte Steuern statt in die allgemeine Kasse zu gehen, zweckgebunden waren: zum Unterhalt einer Moschee, zur Finanzierung der Pilgerfahrt usw.

Col termine waqf , cui in area nordafricana viene preferito spesso il termine ḥubus , si indica un bene di manomorta, ossia una fondazione pia islamica, che ha come fine precipuo la conservazione del bene e la sua inalienabilità.La gestione del bene di manomorta può rimanere alla famiglia di chi abbia istituito il waqf ma essa non ne ha comunque la proprietà.Generalmente i beni waqf sono istituiti a fini caritatevoli, per aiutare le categorie meno fortunate della società o i pellegrini o i devoti. Con l'andar del tempo, tuttavia, l'accumulo di un patrimonio spesso diventato del tutto improduttivo e addirittura del tutto inagibile, ha condotto vari Stati islamici ad avocare a sé il compito di provvedere in merito, con l'istituzione sovente di appositi ministeri in grado di provvedere al loro concreto funzionamento.

Een waqf is een religieuze stichting volgens het  islamitisch recht. Een waqf wordt met een ingezameld of nagelaten geld gesticht en kan een moskee, een bron, molen, madrassa, een wees- of badhuis beheren. Vanaf het prille begin is de waqf niet op winst gericht. Dat betekent dat een waqf ook moeilijk kapitaal kan aantrekken.
