Presumption of fact
Presumption of fact - A legal term used to describe a presumption that one makes to determine that a fact is probably true. For example: A man while peering through his window observed a brown Ford cargo van leaving a neighbor's house across the street. He did not notice the time but he noticed that at the time the van left the house, another neighbour was feeding her cat on the porch, which she does between 12:01pm and 12:30pm every day. The man believes on this basis that the van left the neighbour's house sometime soon after midday.
