Distraint

In English law, distraint or distress is a remedy for non-payment of rent. Distraint is the act or process "whereby a person (the distrainor), without prior court approval, seizes the personal property of another located upon the distrainor's land in satisfaction of a claim, as a pledge for performance of a duty, or in reparation of an injury." Distraint typically involves the seizure of goods (chattels) belonging to the tenant by the landlord to sell the goods for the payment of the rent.

Utmätning är en juridisk term och innebär att en borgenär, efter att ha skaffat sig en exekutionstitel, begär att kronofogdemyndigheten skall ta egendom ifrån gäldenären. Kronofogdemyndigheten kan också besluta om utmätning av lön, vilket innebär att arbetsgivaren tar ett bestämt belopp från den anställdas lön och betalar in den summan till Kronofogdemyndigheten.
