The Digital Millennium Copyright Act (DMCA) is a United States copyright law that implements two 1996 treaties of the World Intellectual Property Organization (WIPO). It criminalizes production and dissemination of technology, devices, or services intended to circumvent measures (commonly known as digital rights management or DRM) that control access to copyrighted works. It also criminalizes the act of circumventing an access control, whether or not there is actual infringement of copyright itself. In addition, the DMCA heightens the penalties for copyright infringement on the Internet. Passed on October 12, 1998, by a unanimous vote in the United States Senate and signed into law by President Bill Clinton on October 28, 1998, the DMCA amended Title 17 of the United States Code to extend the reach of copyright, while limiting the liability of the providers of on-line services for copyright infringement by their users.

B. der RIAA, einem Verband der Musikindustrie) erweitert. Das DMCA versucht die neuen Verhältnisse zu regeln, die sich aus der Möglichkeit, durch digitale Reproduktion perfekte Kopien zu erstellen, ergeben. Es kriminalisiert die Produktion und Verbreitung von Technologien, Geräten oder Diensten, die Zugriffsbeschränkungen (wie DRM) auf kopiergeschützte Werke umgehen (also „den Kopierschutz knacken“), auch wenn dabei das Copyright selbst gar nicht verletzt wird. Es verschärft zudem die Strafen für Copyright-Verletzungen im Internet.

Le Digital Millennium Copyright Act (DMCA) est une loi américaine adoptée en 1998. Le but de ce texte est de fournir un moyen de lutte contre les violations du droit d'auteur. Il vise à établir une législation de la propriété intellectuelle adaptée à l'ère numérique. Parmi les dispositions contenues dans le texte, il y a la possibilité d'interdire explicitement le contournement des technologies utilisées pour protéger les documents assujettis au droit d'auteur. Ainsi la loi interdit le détournement d'une protection contre la copie mais aussi, la distribution ou la mise à disposition de procédés qui permettent ce détournement. On assiste notamment à la censure de résultats sur Google (par exemple en ce qui concerne les requêtes portant sur le logiciel de peer to peer Kazaa [1][2])
