De facto

De facto is a Latin expression that means "in fact" or "in practice" but not spelled out by law. It is commonly used in contrast to de jure (which means "by law") when referring to matters of law, governance, or technique (such as standards), that are found in the common experience as created or developed without or contrary to a regulation. When discussing a legal situation, de jure designates what the law says, while de facto designates action of what happens in practice.

De facto ist ein lateinischer Ausdruck für „nach Tatsachen“, „in der Praxis“, „tatsächlich“ (vgl. „in praxi“).Mit de facto wird ein Umstand dann bezeichnet, wenn er als weit verbreitet und allgemein anerkannt gilt, auch wenn nicht durch entsprechende Institutionen formal als de jure festgelegt. De jure bezeichnet also den rechtlichen Soll-Zustand, de facto den tatsächlichen Zustand (Ist-Zustand).Diese Begriffe werden aber auch für die Kategorisierung von Staaten verwendet. So ist zum Beispiel Somaliland ein de facto, jedoch nicht de jure anerkannter Staat (ein so genanntes Stabilisiertes De-facto-Regime). Im Gegensatz dazu ist Somalia zwar international ein de jure anerkannter, de facto jedoch nicht existenter Staat.

De facto è una locuzione latina per dire "di fatto" ed è usata soprattutto per questioni che riguardano la legge, il governo o tecniche (come gli standard), in contrasto con de jure che significa "per legge". Ad esempio viene chiamato "standard de facto" uno standard che, benché non ufficializzato da ISO o altri enti, è così diffuso da essere comunque riferimento per tutti.

De facto is een Latijnse uitdrukking die "in feite" of "in de praktijk" betekent. Het wordt vaak als tegenovergestelde gebruikt van de jure wanneer men verwijst naar wetten, bestuur of techniek. De facto impliceert dat iets niet helemaal universeel geaccepteerd wordt. Wanneer een juridische situatie wordt besproken, betekent de jure expliciet wat de wet zegt, terwijl de facto refereert aan wat er gebeurt in praktijk, wat van elkaar kan verschillen.
