Checks and Balances

Separation of powers is a term coined by French political Enlightenment thinker Baron de Montesquieu, is a model for the governance of democratic states. The model is also known as Trias Politica.Under this model, the state is divided into branches, and each branch of the state has separate and independent powers and areas of responsibility. The normal division of branches is into the Executive, the Legislative, and the Judicial.Proponents of separation of powers believe that it protects democracy and forestalls tyranny; opponents of separation of powers, such as Professor Charles M. Hardin, have pointed out that, regardless of whether it accomplishes this end, it also slows down the process of governing, promotes executive dictatorship and unaccountability, and tends to marginalize the legislature.

La séparation des pouvoirs est un principe de répartition des différentes fonctions de l'État, qui sont confiées à différentes composantes de ce dernier. On retient le plus souvent la classification de Montesquieu, appelée Trias Politica :le pouvoir législatif, confié au parlement ;le pouvoir exécutif, confié au gouvernement, à la tête duquel se trouve un chef d'État et / ou de gouvernement ;le pouvoir judiciaire, confié au juge.

Checks and Balances ist eine Bezeichnung für die gegenseitige Kontrolle (checks) von Verfassungsorganen eines Staates, zur Herstellung eines dem Erfolg des Ganzen förderlichen Systems partieller Gleichgewichte (balances), zunächst im Wesentlichen, um einer Diktatur vorzubeugen. Analytisch entstammt die Betrachtungsweise bereits der Antike, nämlich der Analyse des römischen Verfassungslebens durch den griechischen Historiker Polýbios.

Gewaltenteilung ist die Verteilung der Staatsgewalt auf mehrere Staatsorgane zum Zwecke der Machtbegrenzung und der Sicherung von Freiheit und Gleichheit. Nach historischem Vorbild werden dabei die drei Gewalten Gesetzgebung (Legislative), Vollziehung (Exekutive) und Rechtsprechung (Judikative) unterschieden. Ihren Ursprung hat das Prinzip der Gewaltenteilung in den staatstheoretischen Schriften von John Locke und Montesquieu (Vom Geist der Gesetze, 1748), die sich gegen Machtkonzentration und Willkür im Absolutismus richteten.

Trójpodział władzy to podział sfer funkcjonowania państwa, spopularyzowany przez francuskiego myśliciela oświecenia, Monteskiusza. Monteskiusz nie był twórcą koncepcji trójpodziału władzy, a więc mówienie o "monteskiuszowskim trójpodziale władz" jest błędem. Problemem rozdziału władz filozofowie zajmowali się co najmniej od czasów koncepcji Marsyliusza z Padwy, o ustroju mieszanym (rządach mieszanych) i suwerenności ludu, które to koncepcje miały duży wpływ na poglądy Monteskiusza.

La separazione dei poteri, per come è stata descritta da Montesquieu, è uno dei principi fondamentali dello stato di diritto. Essa consiste nell'individuazione di tre funzioni pubbliche, legislazione, amministrazione e giurisdizione, e nell'attribuzione delle stesse a tre distinti poteri dello stato, intesi come organi o complessi di organi dello stato indipendenti dagli altri poteri: il potere legislativo, il potere esecutivo e il potere giudiziario.
