Bail

Traditionally, bail is some form of property deposited or pledged to a court in order to persuade it to release a suspect from jail, on the understanding that the suspect will return for trial or forfeit the bail (and be guilty of the crime of failure to appear). In most cases bail money will be returned at the end of the trial, if all court appearances are made, no matter whether the person is found guilty or not guilty of the crime accused. In some countries, including the US, granting bail is common. Even in such countries, however, bail may not be offered by some courts under some circumstances; for instance, if the accused is considered likely not to appear for trial regardless of bail. Countries without bail imprison the suspect before the trial only if deemed necessary.

Un contrat de bail ou un contrat de location est le contrat de louage par lequel l'une des parties (appelée bailleur) s'engage, moyennant un prix (le loyer) que l'autre partie (appelée preneur) s'oblige à payer, à procurer à celle-ci, pendant un certain temps, la jouissance d'une chose mobilière ou immobilière. Le contrat de location (c'est-à-dire la signature d'un bail) n'est donc pas restreint au seul domaine immobilier. Le bail peut porter sur des « biens meubles ou immeubles » comme l'indique, en droit français, l'article du Code civil français.

Eine Kaution (lat. cautio, „Sicherheit“, „Vorsicht“) ist eine vereinbarte Sicherheitsleistung.Im Allgemeinen wird eine Kaution, meist in Form von Geld, vom Schuldner an den Gläubiger übergeben und die Verfügungsrechte hierzu dem Gläubiger eingeräumt. Erfüllt der Schuldner seine Verbindlichkeit, so wird die Kaution dem Schuldner vom Gläubiger zurückgegeben, bei Geld in der Regel zuzüglich aufgelaufener Zinsen. Die Modalitäten der Kaution sind Vereinbarungssache zwischen den Parteien, sofern keine gesetzlichen Bestimmungen konkrete Formen erzwingen.
