Alibi

An alibi is the plea or mode of defense under which a person on trial for a crime proves or attempts to prove that he was in another place when the alleged act was committed; as, to set up an alibi; to prove an alibi. The Criminal Law Deskbook of Criminal Procedure states: "Alibi is different from all of the other defenses...it is based upon the premise that the defendant is truly innocent.". In the Latin language "alibi" means "somewhere else."

Ein Alibi (lat. zu alibi „anderswo“ von alius „ein anderer“) ist der Beweis oder Nachweis dafür, dass eine verdächtige Person sich zur Tatzeit nicht am Tatort aufgehalten hat und so als Täter nicht in Frage kommt. Es bedarf im strafrechtlichen Ermittlungsverfahren der Bestätigung durch Zeugen oder durch Indizien. Die Alibi-ermittlung ist wesentlicher Teil der Kriminalistik. Unterschieden wird zwischen dem personellen und dem technischen Alibi.

Alibi - dowód w postępowaniu karnym na okoliczność, że podejrzany albo oskarżony znajdował się w miejscu innym niż miejsce popełnienia zarzucanego mu przestępstwa. W szerszym znaczeniu mianem alibi określany jest każdy dowód przesądzający, że podejrzany lub oskarżony nie mógł popełnić zarzuconego mu przestępstwa. Rodzajem alibi jest tzw. żelazne alibi - czyli alibi, którego nie sposób podważyć. Słowo alibi pochodzi z łaciny, gdzie oznacza gdzie indziej.
