ARBITRATION

Arbitration is a legal technique for the resolution of disputes outside the courts, wherein the parties to a dispute refer it to one or more persons such as (the "arbitrators", "arbiters" or "arbitral tribunal"), by whose decision (the "award") they agree to be bound.  Arbitration in the United States and in other countries often includes alternative dispute resolution (ADR), a category that more commonly refers to mediation (a form of settlement negotiation facilitated by a neutral third party). It is more helpful, however, simply to classify arbitration as a form of binding dispute resolution, equivalent to litigation in the courts, and entirely distinct from the various forms of non-binding dispute resolution, such as negotiation, mediation, or non-binding determinations by experts.

Das Schiedsverfahren (engl. arbitration) ist das Verfahren vor einem Schiedsgericht (privates Zivilgericht). Voraussetzung ist eine Schiedsvereinbarung zwischen den Parteien. Dadurch wird der Rechtsweg zu den staatlichen Zivilgerichten ausgeschlossen. Der bürgerliche Rechtsstreit zwischen dem Schiedskläger und dem Schiedsbeklagten wird durch einen Schiedsspruch eines oder mehrerer Schiedsrichter beendet. Der Schiedsspruch tritt an die Stelle eines Urteils eines staatlichen Gerichts. Er ist für die Parteien bindend und kann für vollstreckbar erklärt werden.

Arbitraż to metoda rozwiązywania sporów prawnych w sprawach cywilnych bez udziału sądu powszechnego, w której kompetencje takiego sądu powierza się bezstronnemu specjaliście. Może mieć charakter jednorazowy bądź instytucjonalny. W arbitrażu jednorazowym każda ze stron sporu wybiera własnego arbitra (lub arbitrów), a ci następnie powołują superarbitra. Tak wybrany skład rozstrzyga spór w oparciu o uzgodnione wcześniej zasady. Arbitraż instytucjonalny funkcjonuje w oparciu o profesjonalną organizację zajmującą się arbitrażem. Przykładami takowych są Sąd Arbitrażowy przy Krajowej Izbie Gospodarczej w Warszawie lub międzynarodowy Sportowy Sąd Arbitrażowy w Lozannie.

In diritto, l'arbitrato è una modalità di soluzione stra-giudiziale (cioè senza ricorso a processo ordinario) delle controversie civili e commerciali, svolta mediante l'affidamento di un apposito incarico ad uno o più soggetti terzi rispetto alla controversia, detti arbitri, normalmente scelti dalle parti, i quali producono una loro pronuncia, detta lodo, che contiene la soluzione del caso ritenuta più appropriata.
