APPEAL

In law, an appeal is a process for making a formal challenge to an official decision.The specific procedures for appealing, including even whether there is a right of appeal from a particular type of decision, can vary greatly from country to country. Even within a jurisdiction, the nature of an appeal can vary greatly depending on the type of case.An appellate court is a court that hears cases on appeal. Depending on the particular legal rules that apply to each circumstance, a party to a court case who is unhappy with the result might be able to challenge that result in an appellate court on specific grounds. These grounds typically could include errors of law, fact, or procedure (in the United States, due process).

Die Berufung, auch Appellation, ist ein Rechtsmittel gegen ein Urteil meist der ersten Instanz. Mit der Berufung können sowohl rechtliche als auch tatsachengestützte Rügen verfolgt und neue Tatsachen und Beweise angeführt werden. Das Berufungsverfahren hat also einen dualistischen Charakter, es ist sowohl ein Rechtsbehelfs- als auch ein Erkenntnisverfahren.

Apelacja (łac. appellatio - odwołanie) to odwołanie się od wydanego wyroku. W prawie sądowym apelacja jest środkiem odwoławczym od wyroku sądu pierwszej instancji do sądu drugiej instancji.Apelacja przysługuje wyłącznie od wyroku sądu pierwszej instancji. Od wyroków wydanych w pierwszej instancji przez sąd rejonowy apelacja przysługuje do sądu okręgowego, natomiast jeśli wyrok w pierwszej instancji zapadł przed sądem okręgowym, sądem drugiej instancji jest sąd apelacyjny.Apelację należy wnosić na piśmie, do sądu odwoławczego za pośrednictwem sądu pierwszej instancji, w terminie 7 dni od daty doręczenia wyroku z uzasadnieniem. Gdy jednak strona nie zażądała uzasadnienia wyroku w terminie tygodniowym od ogłoszenia sentencji wyroku, termin do wniesienia apelacji biegnie od dnia, w którym upłynął termin do żądania uzasadnienia.
